Covid19 and Migration

Covid19 has caused havoc with international travel and visas being granted for Australia.

Most visas that have been lodged overseas have been placed on hold until travel restrictions cease. Some partner visas have been granted and travel has been permitted.

Some visa categories inside Australia are being processed more quickly, Partner 820/801 and 100 in particular. However the backlog of these is so high that it will take some to clear.

Many people who are stuck inside Australia have to get a new visa to stay legal. If you are in this situation, contact us to assist. It is really important to not let your visa expire. The government attitude remains the same, you MUST care for your immigration status.

Partner Sponsorship Changes 2021

Major changes to all partner visas are possible in 2021.

The Sponsor (Australian Citizen or Permanent Resident) may have to apply and be approved BEFORE the Visa Applicant can apply.

Some of the issues that need to be addressed are:

How long will the Sponsor approval take?
This will depend on many things. The Sponsor needs police checks from all countries lived in for a certain period. These will be needed BEFORE the visa can be applied for.
Has the Sponsor got any criminal history? Some can be overcome, more serious matters will be a major problem.
If the Visa applicant is waiting in Australia to apply, how long do they have on their visa? Will there be enough time?
It may be a good idea to contact us now if before November 2021 to assess whether you can go ahead urgently.

Visa refused? Need to appeal?

The Tribunal (AAT) is fully independent of the Department that made the refusal decision on your visa. The AAT will fully review your case and can make a decision to “remit” the refused visa decision back to the Department with instructions that you do meet requirements.

Easy? Definitely not . It takes a good understanding of immigration law to win but the AAT is better qualified than the Department in many cases to make the visa refusal decision. This is definitely NOT a do it yourself process. The Tribunal (AAT) Members (the “judges”) job is to find the truth and you will have a Hearing that could be at least 2 hours and can go to 5 h

We will assess your case and advise if you have a chance to appeal successfully. You MUST move quickly . Usually you only get 21 days from when the visa refusal happened to appeal to the AAT (if in Australia) and 70 days (if outside Australia).

Do NOT expect AAT appeals will be easy . They are tough but we have good success. We must review the full file and fix up the problems the Department found.

The process from visa refusal to an AAT Hearing can take up to 2 years but if in Australia, you generally can stay. Visas refused outside Australia are usually decided by the AAT between 6 and 12 months.

Costs start with the government fee of $3000 (1 July 2021). Our fees will depend on the complexity of the case. We can usually assess quickly and free if you send us the Decision Record from the Department.

We have managed many appeals where an applicant was refused after they did the visa themselves or used another preparer. You should NOT use the same business if the did not succeed with the visa. We have not needed to appeal our own visa applications. We plan to win.

DNA Testing for a Child Visa

Will I be asked to have a DNA test?

If the Department want more proof that the child you are wanting a visa for is really your biological child, they will ask that you have a DNA test. This confirms your family relationships for a visa or if you want to claim Australian citizenship by descent.

They will be more likely to ask for a DNA test if you or any family members do not have a birth certificate or a family book, or if these documents do not appear reliable.

If they want a DNA test, they we will send you a letter which will include information about DNA testing and about how to select a testing laboratory and sample collector. They will also send the forms that you can use.

It is important if you agree to have a DNA test, you follow the instructions on the letter. If you organise a test before being asked to and do not choose a suitable laboratory, it may not meet the standards and may not be accepted by as evidence of your family relationships.

What is DNA?

DNA (deoxyribonucleic acid) is genetic material present in every cell of our bodies, including our blood, saliva, skin and hair. We inherit our DNA from biological parents, therefore people who are related by blood have parts of DNA from their parents.

What is a DNA test?

DNA tests show whether you are biologically related to another person. It shows that you are biologically related to your parents, your children, or other family members.

A laboratory test compares the DNA in cells from two or more people. The cells are taken from a mouth swab or blood sample.

A DNA test confirms your relationship. Sometimes, a DNA test of other family members (such as a brother and a sister) does not give a clear result. In this case, the laboratory will explain the result. However, a DNA test is conclusive evidence you are related, it cannot be wrong.

Assurance of Support – Parent Visas

April 1. 2018 saw very significant changes and increases in the AoS process for Contributory Parent 173 and 143 visas.

The visas had no changes but the AoS, Assurance of Support, now needs much higher incomes for the sponsor or Assurer to have to be approved. Without an AoS approval, the 173 and 143 visas cannot be granted.

A 143 Contributory Parent visa needs an AoS Assurance of Support to be granted. The sponsor or other suitable people are assessed by the Department of Human Services (not the visa Department of Home Affairs). They are assessed as to whether they can provide financial support if the applicants need social services during the first 10 years of Permanent Residency. The visa holders for 143 Contributory Parent visas cannot access Centrelink or Social Welfare for this 10 years. They can get Medicare.

Health waiver? PIC 4005 or 4007?

Have you received a letter advising you have a health problem? Your visa may be refused?

A waiver of meeting the health requirement (a health waiver) can be obtained for applicants of many visas. The visa health waiver means you can get the visa granted even if you have a significant health condition picked up in the medical check.

A visa health waiver properly done can help you get the visa when the Department may have decided there may be high costs or prejudices to access to medical services by Australians. These are referred to as a PIC 4007 health waive r. Without a health waiver your visa will be refused if you do not meet the health check.

Domestic or Family Violence and Visas

Are you on a Temporary Partner visas and worried that leaving your sponsor, you will be forced to leave Australia? You may be able to stay and get the PR visa if you can prove Domestic or Family Violence. It can allow the visa applicant to apply for permanent residency.
